Terms of Service

TERMS OF SERVICE

1. Acceptance of Terms & Eligibility

By creating an account, downloading the mobile application, or unlocking any bicycle provided by Bunnihop ("Company," "we," "us," or "our"), operating consumer-facing services under the Bunnihop brand, you ("User," "Rider," or "you") agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Bunnihop platform or services.

To access and use our micro-mobility services, you represent and warrant that:

  • You are at least 18 years of age or possess legal capacity under applicable law to enter into a binding contract.
  • You are a registered student, faculty member, or authorized individual operating within designated service zones.
  • All registration information you submit is accurate, current, and complete.

2. User Accounts & Security

  • Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials, login codes, and access tokens.
  • Prohibition of Account Sharing: Your Bunnihop account is strictly non-transferable. You must not permit any third party to ride, unlock, or operate a bicycle using your account. You are fully liable for all rides, fees, damages, or violations incurred under your credentials.
  • Unauthorized Access: You agree to notify Bunnihop support immediately if you suspect any unauthorized access to or compromise of your account.

3. Mandatory Pre-Ride Inspection & Safety Rules

3.1 Pre-Ride Inspection

Before unlocking and mounting a Bunnihop bicycle, you must conduct a thorough safety visual check, including but not limited to:

  • Operational front and rear brakes.
  • Proper tire inflation and tread condition.
  • Frame structural integrity and secure handlebars.
  • Functional locking mechanism (verifying the electronic smart lock or manual combination lock engages/disengages smoothly) and active status lighting, where equipped.

Reporting Existing Damage: If you discover any defect, safety issue, physical damage, or lock malfunction (such as a jammed combination lock dial) prior to riding, you must not ride the bicycle. You must report the issue immediately through the app. Beginning a trip without reporting pre-existing damage signifies that the bicycle is in safe, fully functional working order, and you may be held responsible for subsequent damage.

3.2 Helmets and Traffic Laws

  • No Helmet Provision: Bunnihop does NOT provide helmets or protective gear with rentals. You acknowledge that you are solely responsible for providing and wearing your own protective headwear.
  • Compliance with Laws: You agree to comply with all national, local, and university traffic regulations, road rules, and pedestrian restrictions.
  • Safety Recommendation: You are strongly advised to wear an approved safety helmet while operating a bicycle. Bunnihop is not responsible for any personal injuries resulting from riding without protective equipment.

4. Operating Rules, Riding Boundaries & Parking Policy

4.1 Permitted Operating Area

Unlike traditional micro-mobility zone restrictions, Bunnihop bicycles can be ridden anywhere without geographic boundary lockouts during your active rental period. However, all trips remain subject to mandatory parking rules upon completion.

4.2 Prohibited Uses

When operating a Bunnihop bicycle, you strictly agree NOT to:

  • Carry any passengers (bicycles are designed for single riders only).
  • Transport heavy, bulky, or dangerous cargo that interferes with the safe handling of the bicycle.
  • Operate the bicycle under the influence of alcohol, drugs, medication, or any substance that impairs motor skills or judgment.
  • Engage in stunt riding, off-road racing, mountain trails, or deliberate trick maneuvers.
  • Use the bicycle for commercial transport, courier, or delivery services without explicit written authorization from Bunnihop.
  • Dismantle, tamper with, paint, hack, or vandalize the bicycle or its locking/GPS hardware.

4.3 Mandatory Dedicated Dropoff Zone Parking

  • Dedicated Dropoff Zones: You may ride anywhere during your rental, but at the conclusion of your trip, the bicycle must always be returned and locked inside an official, designated Bunnihop dropoff zone.
  • Obstruction Rules: When ending a ride at a dedicated dropoff zone, you must never park a bicycle in a manner that blocks:
  • Public footpaths, walkways, or running tracks.
  • Emergency exits, fire hydrants, or service accesses.
  • Wheelchair access ramps or disabled parking zones.
  • Active vehicle lanes or building entryways.
  • Photo Verification: You must upload a clear photograph showing the securely locked and correctly parked bicycle via the app at the end of every trip.

5. Rates, Payment & Day Pass Overtime Fees

  • Pricing Architecture: Rentals are billed based on the active pricing tier selected in the app (e.g., Pay-As-You-Go per-minute rates, trip passes, or recurring subscription plans).
  • Day Pass 24-Hour Rule & Overtime Charges: Day Pass rentals cover up to a maximum continuous duration of 24 hours from the moment of unlock. If a bicycle is kept, ridden, or unreturned past the 24-hour mark, an additional overtime fee per hour will automatically apply to your account for every extra hour (or fraction thereof) until the bicycle is properly returned to a dedicated Bunnihop dropoff zone.
  • Payment Authorization: You authorize Bunnihop to automatically charge your linked payment method (debit/credit card) or deduct from your active Bunnihop Wallet balance for all accumulated trip charges, subscription fees, overtime charges, and penalty fines.
  • Pre-Authorizations & Holds: We reserve the right to execute a temporary security pre-authorization hold on your payment method prior to initiating a rental.
  • Non-Refundable Credit: In-app wallet credits, promotional bonuses, and subscription passes are non-refundable and hold no monetary value outside the Bunnihop ecosystem.

6. Fines, Penalties & Stolen Bike Liability

Failure to comply with these terms will result in direct financial penalties billed to your payment method:

  • Improper Return / Out-of-Hub Penalty: Abandoning a bicycle outside a dedicated Bunnihop dropoff zone incurs an automatic relocation penalty fee.
  • Overtime Pass Charges: Failing to return a Day Pass rental within 24 hours incurs hourly overtime surcharges as specified in Section 5.
  • Damage & Vandalism Charge: If a bicycle is returned damaged due to reckless operation, negligence, or unauthorized modification, you will be billed for repair parts and technical service labor costs.
  • Stolen or Unrecovered Bicycle Fee: If a bicycle is left unlocked, improperly locked, or abandoned outside a dropoff zone, and is subsequently lost or stolen, you are liable for a replacement fee up to the full replacement value of the bicycle if unrecovered after 24 hours.

7. Assumption of Risk, Disclaimers & Limitation of Liability

7.1 Assumption of Risk

You explicitly acknowledge that riding a bicycle involves inherent risks, including the danger of physical injury, collision with vehicles or pedestrians, road hazards, adverse weather, and property damage. You voluntarily assume all risks associated with your use of Bunnihop services.

7.2 Disclaimer of Warranties

Bunnihop provides all bicycles, software, and services on an "AS IS" and "AS AVAILABLE" basis without express or implied warranties of any kind, including fitness for a particular purpose or error-free operation.

7.3 Limitation of Liability

To the maximum extent permitted by law, Bunnihop, its directors, employees, and partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your rental, inability to use the service, lack of helmet/protective equipment, or accidents occurring during your ride.

8. Account Suspension & Termination

Bunnihop reserves the right, at its sole discretion, to suspend, freeze, or permanently terminate your account immediately without prior notice or refund if:

  • You breach any material term of these Terms of Service.
  • You repeatedly fail to return bicycles to dedicated dropoff zones.
  • You engage in fraudulent payment activity, chargebacks, or vandalism.
  • Your conduct compromises the safety of other community members.

9. Modifications to Terms

Bunnihop reserves the right to modify or update these Terms of Service at any time. Updated terms will be posted on our web platform and app with an updated "Last Updated" date. Continued use of the Bunnihop platform after any modification constitutes your binding acceptance of the revised terms.

10. Governing Law & Contact Information

These terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in South Africa.
